1. Rental Period. The rental period begins on the Start Date and ends on the End Date listed above. Late returns are billed at the prevailing daily rate.
2. Security Deposit. A refundable security deposit of $5,000 is required prior to release of equipment. Deposit is returned within 5 business days of receipt and inspection of returned equipment.
3. Insurance. Renter must maintain a current Certificate of Insurance with 9JA Enterprise LLC listed as Additional Insured for the full equipment replacement value of $65,000 throughout the rental period.
4. Care & Use. Renter agrees to use the equipment only for its intended professional surveying purposes, in accordance with manufacturer specifications, and by trained personnel.
5. Damage, Loss & Theft. Renter is responsible for any damage, loss, theft, or destruction of the equipment during the rental period, regardless of cause, up to the full replacement value.
6. Calibration & Condition. Equipment is delivered calibrated and field-tested. Renter must inspect equipment upon receipt and notify 9JA of any issues within 24 hours.
7. Return Condition. Equipment must be returned in the same condition as delivered, with all components and accessories. Missing or damaged items will be charged at replacement cost.
8. Indemnification. Renter agrees to indemnify and hold harmless 9JA Enterprise LLC from any claims arising from use of the equipment during the rental period.
9. Governing Law. This agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in courts located in Harris County, Texas.
10. Final Agreement. A finalized rental agreement reflecting these terms will be sent for signature upon confirmation of availability.
